1. Acceptance of Terms

By accessing or using the services provided by Algo724 Limited ("Company," "we," "our," or "us"), including Flagship, FundCloud, Hawkeye, and Cadenza API (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

2. Description of Services

Algo724 provides AI-powered trading intelligence tools and APIs:

  • Flagship: Trading co-pilot with AI analysis and automation
  • FundCloud: Personal hedge fund platform with quant models
  • Hawkeye: Web3 portfolio analytics and DeFi tracking
  • Cadenza API: Unified trading API platform for institutional clients

3. User Accounts

3.1 Account Creation

You must create an account to use certain features of the Services. You agree to provide accurate, current, and complete information and to update your information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access or use of your account.

3.3 Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. API Access and Exchange Connections

4.1 Exchange API Keys

To use our trading features, you may need to provide API keys for your exchange accounts. You grant us permission to access your exchange accounts using these credentials solely to provide the Services.

4.2 Security

We encrypt and securely store your API keys. However, you acknowledge that providing API access carries inherent risks. We recommend using read-only API keys where possible and enabling IP whitelisting.

4.3 Your Responsibility

You are solely responsible for all trading decisions and activities in your exchange accounts. We do not execute trades without your explicit authorization.

5. User Conduct

You agree not to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to our systems or other user accounts
  • Interfere with or disrupt the Services or servers
  • Use automated tools to access the Services except through our official APIs
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Resell or redistribute the Services without authorization
  • Violate any applicable trading regulations or exchange terms of service

6. Fees and Payment

6.1 Subscription Fees

Certain Services require paid subscriptions. Fees are charged in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law.

6.2 Payment Processing

Payments are processed through third-party payment processors. You authorize us to charge your payment method for all fees incurred.

6.3 Price Changes

We reserve the right to change subscription fees with 30 days' notice. Continued use of the Services after the notice period constitutes acceptance of the new fees.

7. Intellectual Property

The Services, including all content, features, and functionality, are owned by Algo724 Limited and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Disclaimers and Limitation of Liability

8.1 No Investment Advice

The Services provide tools and information for your use. We do not provide investment, financial, legal, or tax advice. All trading decisions are your sole responsibility.

8.2 No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.3 Trading Risks

Trading cryptocurrencies and other financial instruments involves substantial risk of loss. You may lose some or all of your invested capital. We are not responsible for any trading losses you incur.

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALGO724 LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Indemnification

You agree to indemnify, defend, and hold harmless Algo724 Limited and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Services or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Services at any time, with or without cause or notice. Upon termination, your right to use the Services will immediately cease. You may terminate your account at any time by contacting us at info@algo724.com.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Algo724 Limited is registered, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration body.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
